The applicant (“Contestant”) releases and forever discharges the James E. Ward Agricultural Center, Kansas City Barbecue Society, Smoke on the Shores BBQ Championship, and any authorized third-party media and production companies, including their respective sponsors, employees, owners, executives, agents, contractors, photographers, videographers, representatives, volunteers, assignees, and successors (collectively “SOTS”), from any and all actions, suits, damages, claims, and demands, in law or equity, arising from any loss, damage, or injury, including, but not limited to, those caused by SOTS’ negligent acts or omissions, that relate in any manner to his, her, or its participation in or attendance at the Smoke on the Shores BBQ Championship.
To be clear, Contestant is waiving all rights against SOTS in consideration for being allowed to attend and/or participate in the Smoke on the Shores BBQ Championship. Contestant acknowledges and agrees that SOTS may photograph, film, record, or otherwise capture the event. Contestant grants full permission to SOTS to use Contestant’s name, image, likeness, voice, and appearance as captured in photographs, video recordings, motion pictures, audio recordings, or any other media from the Smoke on the Shores BBQ Championship for any purpose, including promotional, commercial, editorial, and marketing use. This grant of permission is perpetual, worldwide, non-exclusive, and royalty-free.
This agreement shall be governed by and construed in accordance with the laws of the State of Tennessee. Contestant understands and agrees that this waiver is intended to be as broad and inclusive as permitted by law. Contestant (i) acknowledges that he, she, or it has read and agrees to comply with all rules of the Smoke on the Shores BBQ Championship application, (ii) agrees to notify all members of his, her, or its team of these rules, and (iii) assumes full responsibility for his, her, or its team’s conduct and compliance.
